Terms of Service

1. Acceptance of Terms

By accessing and using MakerForge™ ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services.

2. Description of Service

MakerForge™ provides users with access to AI-powered 3D model generation tools. You understand and agree that the Service may include advertisements and that these advertisements are necessary for MakerForge™ to provide the Service. You also understand and agree that the service may include certain communications from MakerForge™, such as service announcements and administrative messages.

3. Intellectual Property Rights

• Your Content: You retain ownership of the text prompts and input images you upload to the Service.
• Generated Assets:
  • Free Plan: You are granted a non-exclusive, non-transferable, personal license to use the generated 3D models. You may not sell, distribute, or use them for commercial purposes.
  • Pro Plan: You are granted a commercial license to use, sell, and distribute the generated 3D models (STL/GLB files) created while your subscription is active.
• Platform Rights: MakerForge™ retains the right to use any generated content for promotional purposes, model training, and gallery showcases, unless explicitly restricted by an Enterprise agreement.

4. User Conduct

You agree not to use the Service to:

• Generate content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable.
• Harm minors in any way.
• Impersonate any person or entity.
• Upload or generate content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party.

5. Free Plan Marketplace Auto-Submission

If enabled in platform configuration, generations created from Free accounts may be automatically submitted to Vault as pending review requests so they can be considered for Marketplace exposure.

• Review Required: Auto-submitted assets are not published instantly and remain subject to moderation, quality checks, and policy validation.
• No Publication Guarantee: Submission to Vault does not guarantee approval, featuring, sale eligibility, or ranking in Marketplace listings.
• Plan Rules Apply: Free plan license and download/commercial restrictions remain in effect unless a paid plan explicitly grants broader rights.
• Abuse Prevention: We may reject, limit, or remove submissions and accounts involved in multi-account abuse, automated farming, policy evasion, or fraudulent activity.

6. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

7. Limitation of Liability

In no event shall MakerForge™, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

8. AI Output Variability

You acknowledge that MakerForge™ uses probabilistic AI systems and generated outputs can vary between runs, prompts, and input images. Results are not guaranteed to match any specific artistic expectation, technical preference, or print outcome in every case.

• No Guaranteed Fit: We do not guarantee that every generation will be suitable for your intended artistic, commercial, gameplay, or manufacturing purpose.
• User Responsibility: You are responsible for reviewing, testing, and validating outputs before publishing, selling, or printing.
• Service Nature: Variations, unsuccessful outputs, and iterative attempts are an expected part of AI-assisted generation workflows.

9. Refunds

All purchases of subscriptions, credits, and digital services are final, except where required by applicable law.

• No Refunds for Output Preference: We do not provide monetary refunds for subjective quality concerns, undesired style, or outcomes that require additional prompt iteration.
• No Refunds for Consumed Credits: Credits used for completed generation attempts are non-refundable in cash.
• Billing Exceptions: In verified cases of duplicate billing or payment processing errors, we may issue account corrections or refunds at our sole discretion, subject to legal obligations.
• Support Window: Billing claims must be submitted promptly via the official MakerForge™ support channels with sufficient transaction details.

10. Marketplace License Protection

Assets listed in Marketplace and Vault are protected by license-specific usage terms. By downloading, publishing, remixing, or selling an asset, you agree to comply with the attached license and attribution requirements.

• CC0: Public domain release; attribution is not required, but trademark, brand, and personality rights still apply.
• CC-BY: Attribution is mandatory in redistributions and derivative works.
• CC-BY-SA: Attribution is mandatory and derivative works must be shared under the same license.
• CC-BY-NC: Attribution is mandatory and commercial use is prohibited unless separate written permission is granted.
• Standard License: Use is restricted to MakerForge plan permissions, product policies, and additional platform terms.
• Enforcement: We may remove content, suspend accounts, block downloads, and cooperate with rights holders when license abuse is reported or detected.
